New Oregon PIP Law

In 2019 in Portland, there were more than 11 million rides using ride-sharing services such as Uber, and Lyft. Shockingly, that is 11 million potential accident victims lacking personal injury protection! A new Oregon PIP law provides a statutory fix for this problem. Until now, Oregon law did not require PIP benefits (including medical benefits) for taxis and other ride-sharing services. This issue existed for some time as legislators are not the quickest to act. However, lawmakers finally addressed the problem. The governor just signed into law HB 2393. This bill extends PIP coverage to ride-sharing accidents. Every new insurance policy must comply with this new law. This is a win for everyday people who enjoy using ride-sharing services.
New Oregon PIP Law Timing
In this section, we discuss how the new Oregon PIP law affects no-fault insurance benefits. Firstly, ORS 742.520 covers when PIP benefits are required to be provided. HB 2393 amends ORS 742.520 by changing the language regarding taxis and taxi-like companies such as Uber and Lyft. Before now, the commercial nature of ride-sharing services caused a gap in PIP insurance coverage. However now, new insurance policies should no longer have such a gap and must provide PIP benefits.
Importantly, the new law does not affect existing insurance policies that have already been issued. That is to say, the new law only impacts new and renewed insurance policies issued after January 1, 2022. Eventually, it will apply to all auto insurance policies as they are typically renewed on an annual or semi-annual basis. To conclude, knowing the issuance date of an insurance policy is important and can be verified by requesting a certified copy of the policy's declarations page.
