The Importance of Avoiding Gaps in Treatment

Insurance companies love to fight personal injury cases. They will do everything possible to frustrate the injured person and delay a settlement for as long as possible. Time is on the insurance company’s side – they know that the injured person is racking up medical bills, may be missing work, and generally needs money as soon as possible. The longer they can delay and frustrate the person, they are much likelier to accept much less than they are entitled to. A personal injury lawyer can do everything possible to keep your case moving along and will work to ensure that any settlement fairly compensates you for your damages.

One of the biggest ways you can prevent delays in your case is to avoid gaps in treatment. Some people wait weeks or months after an accident to see a doctor, or they see a doctor and never follow up. This is one of the most common reasons why insurance companies deny claims or refuse to offer a fair settlement. They are argue that the person couldn’t have been seriously injured because they never went to the doctor. Or they argue that so much time passed that the injuries were actually caused by something other than the accident.

In order for a claim to be successful, the injured person will need to prove their injuries were actually caused by the accident in question. Seeing a doctor as soon as possible after an accident and routinely following up helps draw a straight line from the accident to the injury and its subsequent treatment.

Even if you do have a gap in treatment, however, it is possible to collect damages for your injuries. So long as your injury claim falls within the Oregon statute of limitations, you are still eligible to have your case heard by a jury. But by immediately seeking treatment after an accident and by regularly seeing a doctor, you are putting yourself in the best position possible for a successful resolution to your case.
