In rear-end collisions, it is presumed that the driver of the rear vehicle, or the vehicle in back, is at fault for the crash in rear-end accidents. Similarly, liability is often assumed in a head-on collision but in a different manner. In most head-on collisions one vehicle is traveling properly in their lane. The other at-fault vehicle somehow ends up driving in the opposite direction of another lane of travel. So in these types of accidents, you often know who is at fault by simply knowing which lane of travel the accident took place in.

This means that the at-fault driver’s insurance company should assume all liability for the car accident. However, this is not always the case and auto insurance companies have been known to try and blame the other vehicle for the accident. Sometimes they do this by arguing over which lane the accident took place in. It should not be assumed that simply because you were injured in a head-on collision while driving normally yourself the other driver’s insurance company will accept responsibility and reasonably compensate you for your injuries. If the two vehicles crashing into each other are offset, rather than dead-on, only part of the crumple zones are engaged.

A distracted driver may accidentally veer into oncoming traffic. A drunk driver will be unable to maintain a straight line and swerve. An inexperienced or negligent driver may try to overtake another car without sufficient time or in a place where it is illegal to do so.
